60-Day Overpayment Rule Webinar

On February 11, 2016, the Centers for Medicare and Medicaid Services (CMS) released the final version of a 2012 proposed rule which requires Medicare Parts A and B health care providers and suppliers to report and return overpayments by the later of the date that is "60 days after the date an overpayment was identified, or the due date of any corresponding cost report if applicable." The rule became effective on March 14, 2016. A separate final rule was published on May 23, 2014 that addresses Medicare Parts C and D overpayments. The final rule requires Medicare providers to re-organize how they monitor claims and payment in order to comply with a new provider responsibility to report overpayments.

The Protecting Access to Medicare Act of 2014 (H.R. 4302; Pub.L. 113-93) included several important provisions for the skilled nursing center industry. Of key importance is a re-hospitalization program. The Centers for Medicare and Medicaid (CMS) will withhold two percent of Medicare fee-for-services payments to skilled nursing centers. In turn, skilled nursing centers will be able to receive these withheld funds by meeting CMS and industry agreed to facility-specific re-hospitalization rates

On August 30, 2013, the Centers for Medicare & Medicaid Services (CMS) distributed to each individual SNF facility, through its contractor (TMF Health Quality Institute), a Program for Evaluating Payment Patterns Electronic Report (PEPPER). Although these reports have been distributed to other types of health care providers (e.g., hospitals, psychiatric facilities, hospice, etc.), this is the first time that the SNF profession has received PEPPERs, and many AHCA members have questions about how to read and use the report.

While large companies have had compliance programs for many years, smaller chains and single homes may not have yet established a formal plan. Given the fact that compliance is a concept well known and well-practiced in most nursing facilities, adoption of a "compliance program" should not be an overwhelming task. Rather, it is a matter of identifying what aspects of the program are already largely in place and which aspects need to be further developed and then designed into a program that makes sense for your organization.
